Welcome to Gabi's Jewelry Box.

The terms "we", "us" and "our" refer to Gabi's Jewelry Box. Gabi's Jewelry Box operates this website and online store, including the information, content, features, tools, products and services offered through it (the "Services").

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy, Refund Policy and any other policies referenced on this website, govern your access to and use of the Services and purchases made through our store.

By accessing or using the Services, you agree to these Terms.

Nothing in these Terms is intended to limit or waive any rights granted to consumers under mandatory Israeli law, including the Consumer Protection Law, 5741-1981, and applicable regulations. If any provision of these Terms conflicts with a mandatory provision of Israeli law, the mandatory provision will prevail.

SECTION 1 – ACCESS AND LEGAL CAPACITY

You may use the Services only in accordance with applicable law.

If you are under 18 years of age or otherwise do not have full legal capacity to enter into a transaction, you may make purchases only to the extent permitted by Israeli law and, where required, with the consent of your parent, guardian or legal representative.

When placing an order, you may be required to provide information including your name, email address, telephone number, billing information, payment details and shipping address.

You are responsible for ensuring that the information you provide is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to accurately display and describe our jewelry, including its materials, measurements, colors, appearance and other characteristics.

Because displays and devices may reproduce colors differently, there may be minor variations between how a product appears on your screen and its appearance in person.

Handmade products may also have small variations between individual pieces where these variations are inherent in the handmade nature of the product.

These provisions do not limit your rights under Israeli law if a product is defective, materially different from its description or otherwise does not conform to your order.

We may modify or discontinue products and collections from time to time.

Product availability is subject to stock, and placing an item in your cart does not reserve it.

Where a product is handmade, personalized, engraved, custom-sized, altered or manufactured specifically according to your request, special conditions may apply to cancellations or returns, to the extent permitted by Israeli law. Any such conditions will be communicated where relevant.

SECTION 3 – ORDERS, CANCELLATIONS AND RETURNS

Submitting an order constitutes an offer to purchase the selected products.

An order is accepted after we successfully process the payment and send you an order confirmation, subject to availability and verification.

We may decline or cancel an order for legitimate reasons, including:

Product unavailability
Payment failure
Suspected fraud or unauthorized use of a payment method
A material pricing or product-information error
An inability to deliver the order
A legal or regulatory restriction

If we cancel an order after payment has been collected, the amount collected for the cancelled order will be refunded in accordance with applicable law.

Consumer Cancellation Rights

Purchases made through this website may constitute distance-sale transactions under Israeli consumer protection law.

Consumers have the right to cancel eligible transactions within the periods and subject to the conditions prescribed by Israeli law.

For goods purchased online, the statutory cancellation period will generally include the applicable 14-day cancellation period provided under Israeli consumer protection law, subject to statutory conditions, exceptions and any extended rights that apply to particular consumers.

Certain products, including goods made specifically for a customer, may be excluded from statutory cancellation rights where Israeli law provides such an exception.

Where permitted by law, a cancellation fee may apply. Any cancellation fee charged by us will not exceed the maximum permitted by Israeli law.

If cancellation results from a defect, non-conformity, failure to supply the product as agreed or another circumstance in which Israeli law prohibits the charging of a cancellation fee, no such fee will be charged.

Our full return, refund and cancellation conditions are described in our Refund Policy.

If our Refund Policy provides you with greater rights than required by law, the more favorable policy will apply. It will never be interpreted as reducing rights granted by mandatory Israeli law.

SECTION 4 – PRICES AND PAYMENT

Unless otherwise stated, prices on the website are displayed in New Israeli Shekels (₪).

Prices displayed to consumers are intended to reflect the total price required under Israeli consumer protection law and include VAT where VAT is applicable to the transaction.

Shipping charges, where applicable, will be disclosed before the order is completed.

The final amount payable will be displayed during checkout before you confirm your order.

Prices, promotions and discounts may change from time to time. A change in price after an order has been accepted will not affect the price of that accepted order, except where permitted or required by law.

Promotional offers may be subject to separate conditions disclosed as part of the promotion.

You agree to provide accurate and authorized payment information.

Payment processing may be performed by Shopify Payments or other third-party payment providers. Their services may also be subject to their respective terms and privacy policies.

SECTION 5 – SHIPPING AND DELIVERY

We currently ship within Israel only.

Orders are prepared and dispatched within up to 3 business days after order confirmation, unless a different processing period is clearly stated for a particular product.

Business days are generally Sunday through Thursday and exclude Israeli public holidays and other days on which normal commercial operations are unavailable.

Estimated delivery times and shipping options are provided separately in our Shipping Policy and/or during checkout.

Delivery estimates are estimates rather than guaranteed arrival dates unless we expressly state otherwise.

Delays may occasionally occur because of circumstances outside our reasonable control, including carrier disruptions, security situations, severe weather, strikes or other exceptional circumstances.

Nothing in this section limits any remedy available to you under Israeli law where an order is not delivered within the period agreed with you or where we otherwise fail to fulfill our obligations.

Customers are responsible for providing accurate delivery information. Please contact us as soon as possible if you discover an error in your address.

SECTION 6 – INTELLECTUAL PROPERTY

The website and its content, including our branding, photographs, product photographs, graphics, text, designs, logos, videos and other original content, are owned by or licensed to Gabi's Jewelry Box unless otherwise stated.

Such content may be protected by Israeli intellectual property laws and applicable international laws and agreements.

You may access and use the website for your own personal, non-commercial use.

Unless permitted by law or authorized by us in writing, you may not reproduce, distribute, commercially exploit, modify, publish or otherwise use our protected content.

The Shopify name, logo and related trademarks are owned by Shopify or its affiliates.

Other trademarks appearing on the Services remain the property of their respective owners.

SECTION 7 – OPTIONAL AND THIRD-PARTY TOOLS

From time to time, we may provide access to functionality, applications or services provided by third parties.

We do not necessarily control such third-party services.

Your use of third-party tools may also be governed by the terms and privacy policies of the relevant third-party provider.

To the maximum extent permitted by applicable law, we are not responsible for acts, omissions, outages or services of independent third-party providers that are outside our reasonable control.

Nothing in this section limits rights that cannot legally be excluded.

The Services may contain links to third-party websites or services.

We do not control and are not responsible for the content, availability, policies or practices of independent third-party websites.

You should review the applicable terms and privacy policies before purchasing products or providing personal information to a third party.

Nothing in this section limits responsibility that cannot legally be excluded under Israeli law.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Gabi's Jewelry Box is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

Purchases made from our store are transactions between you and Gabi's Jewelry Box, not between you and Shopify.

Gabi's Jewelry Box remains responsible for its obligations to customers in connection with products purchased from our store.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for Gabi's Jewelry Box's fulfillment of your purchase.

Nothing in this section limits any non-waivable rights or remedies available under applicable law.

SECTION 10 – PRIVACY AND PERSONAL INFORMATION

Our collection and use of personal information are governed by our Privacy Policy and applicable Israeli privacy and data-protection law, including the Privacy Protection Law, 5741-1981 and regulations issued under it.

Our Services are hosted using Shopify. As a result, Shopify and other service providers may process information necessary to provide ecommerce, payment, hosting, analytics, communication, fraud-prevention and related services.

Some service providers may process or store information outside Israel.

Any collection, processing, disclosure or international transfer of personal information will be handled subject to applicable legal requirements.

Shopify's own processing of information is also subject to Shopify's applicable privacy policies.

SECTION 11 – REVIEWS, COMMENTS AND FEEDBACK

If you voluntarily submit reviews, photographs, comments, suggestions or other content ("Feedback"), you confirm that you have the right to provide that content.

Subject to applicable law and our Privacy Policy, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display and adapt Feedback for purposes connected with operating, improving and promoting Gabi's Jewelry Box.

You must not submit content that:

Infringes another person's intellectual property or privacy rights
Is knowingly false or misleading
Is unlawful, abusive or defamatory
Contains malicious software
Misrepresents your identity or experience with a product

Where a review or endorsement was provided in exchange for compensation, a gift, discount or other incentive, this must be disclosed where required by applicable law.

We may remove Feedback that violates these Terms or applicable law.

Occasionally, the website may contain typographical mistakes, incorrect product information, pricing errors or other inaccuracies.

If an error materially affects an order you have already placed, we will contact you where appropriate.

If we cannot fulfill an accepted order because of a material error or product unavailability, we may cancel the affected order and refund amounts paid for it, subject to applicable Israeli law.

Nothing in this section permits us to avoid obligations or consumer rights imposed by law.

SECTION 13 – PROHIBITED USES

You may not use the Services:

To infringe intellectual property or privacy rights
To harass, threaten or unlawfully harm another person
To submit knowingly false or misleading information

We aim to provide accurate and reliable Services, but websites and online services may occasionally experience interruptions, errors or technical problems.

Except for rights, warranties, representations or remedies that cannot legally be excluded, we do not guarantee uninterrupted or error-free access to the website.

Nothing in these Terms excludes or limits any warranty, obligation or consumer remedy imposed on us by Israeli law, including rights concerning defective products, misdescription, non-conformity or misleading representations.

Any disclaimer in these Terms applies only to the extent permitted by applicable law.

To the maximum extent permitted by applicable law, neither party will be liable for indirect or consequential losses that were not reasonably foreseeable as a result of the relevant breach.

We will not be responsible for losses resulting solely from circumstances outside our reasonable control, except where applicable law provides otherwise.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by Israeli law.

In particular, these Terms do not limit statutory consumer rights or remedies that cannot legally be waived.

SECTION 18 – RESPONSIBILITY FOR MISUSE

You are responsible for losses or claims reasonably resulting from your unlawful use of the Services or your material breach of these Terms, to the extent permitted by applicable law.

Nothing in this section creates an obligation for you to indemnify us for losses caused by our own unlawful conduct, negligence, breach of these Terms or violation of mandatory law.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, it will be interpreted or limited to the minimum extent necessary to make it enforceable where possible.

If this is not possible, the affected provision will be severed.

The remaining provisions will continue in effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Failure to enforce a provision of these Terms on one occasion does not waive the right to enforce it in the future.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and other policies expressly incorporated into them, form the terms governing your use of the Services and purchases from us.

Nothing in these Terms overrides mandatory rights granted under Israeli law.

SECTION 21 – ASSIGNMENT

You may not transfer contractual rights or obligations under these Terms where doing so would materially affect our rights or obligations, except where permitted by law or with our consent.

We may transfer our business or contractual rights and obligations as part of a legitimate business transfer, restructuring or similar transaction, provided that this does not reduce rights granted to you under applicable law.

Nothing in this section restricts rights that Israeli law allows you to transfer.

SECTION 22 – GOVERNING LAW AND JURISDICTION

These Terms and transactions made through Gabi's Jewelry Box are governed by the laws of the State of Israel.

Any dispute relating to these Terms, the Services or purchases made through the store will be subject to the jurisdiction of the competent courts in Israel, in accordance with applicable Israeli jurisdiction and procedural rules.

Nothing in this section limits any statutory right a consumer may have regarding the competent court or place in which proceedings may be brought.

Section headings are provided for convenience only and do not affect the interpretation of these Terms.

SECTION 24 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices or applicable law.

The current version will be published on this page.

Where applicable law requires notice of a material change, we will provide such notice.

Changes to these Terms will not retroactively reduce rights relating to transactions already completed or accepted before the change where doing so would be prohibited by law.

Your continued use of the Services after updated Terms take effect constitutes acceptance of those updated Terms to the extent permitted by applicable law.
